Is it legal for one party to a conversation to secretly record the conversatoin without the other party's knowledge or consent?
Contrary to popular belief, it is perfectly legal to tape record a conversation where at least one party to the conversation has consented to the taping.The other persons who are part of the conversation do not even have to know that they are being recorded. Anything said on the tape would be admissible in a court of law if the party to the conversation were also a party to the litigation. If the person on the tape is not a party to the litigation, then it may only be used in court if the person has just testified, and the statement on the tape contradicts what has just been testified to.
